1. Introduction

Welcome to CoreBookings by Kriya! These Terms of Service ("Terms") govern your use of the CoreBookings platform and related Kriya services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

CoreBookings provides a comprehensive studio management platform designed for fitness studios, yoga and Pilates centers, martial arts and boxing gyms, dance schools, art classes, and similar businesses to manage classes, bookings, payments, and client relationships.

2. Account Registration

To access certain features of the Service, you must register for an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 18 years old to create an account and use our Service.

3. Use of Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates any applicable local, national, or international law
• Impersonate or attempt to impersonate Kriya, a Kriya employee, another user, or any other person or entity
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service
• Use any robot, spider, or other automatic device to access the Service
• Introduce any viruses, trojan horses, worms, logic bombs, or other malicious material
• Attempt to gain unauthorized access to any portion of the Service
• Use the Service to transmit spam or unsolicited communications

4. Payment and Subscriptions

Certain features of the Service require payment. By providing payment information, you represent and warrant that:

• You have the legal right to use any payment method provided
• The information you provide is accurate and complete

Subscription fees are billed in advance on a recurring basis (monthly or annually) and are non-refundable except as required by law or as expressly set forth in these Terms. You may cancel your subscription at any time, but you will not receive a refund for the current billing period.

We reserve the right to change our pricing at any time. Price changes will be communicated to you in advance and will take effect at the start of your next billing period.

5. Data and Privacy

You retain all rights to any data you upload to the Service. By using the Service, you grant us a license to use, store, and process your data solely for the purpose of providing and improving the Service.

6. Intellectual Property

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by Kriya, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your business purposes in accordance with these Terms.

7. Third-Party Services

The Service may integrate with or contain links to third-party services, websites, or resources. We are not responsible for the availability, accuracy, or content of such third-party services. Your use of third-party services is subject to their respective terms and conditions.

Payment processing services (such as Stripe) are provided by third-party payment processors. We are not responsible for errors by payment processors.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KRIYA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from the Service
• Any bugs, viruses, trojan horses, or the like that may be transmitted through the Service by any third party

9. Indemnification

You agree to indemnify, defend, and hold harmless Kriya and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after revisions become effective, you agree to be bound by the revised terms.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Kriya operates, without regard to its conflict of law provisions.
